**Section 3 violation (misbranding issue).*
Hello,
My Amazon seller account was recently suspended due to a **Section 3 violation (misbranding issue).**
I understand that Section 3 suspensions can be challenging to appeal.
If anyone has successfully reinstated their account in a similar situation, I would love to hear what worked for you.
What steps did you take to resolve this issue?
Any insights or guidance on the best approach would be greatly appreciated.
Thank you in advance!

What BRAND were you trying to sell?

It’s a well-known Korean skincare brand. I believe the issue was related to how the product was categorized or described rather than the authenticity itself.
I want to make sure my approach is correct before submitting another appeal. Have you had experience successfully reinstating a Section 3 suspension before? Any insights would be really helpful.

There is a significant difference between 'misbranding' and an authenticity (counterfeit) issue.
On the one hand it sounds as though you sold a brand name as a 'generic' while on the other it sounds like an IP complaint.
Find the suspension notice and POST THAT (the ENTIRE thing) but remove all personal information first.
Anyone answering will need to see what wording they used and what they are asking for.
If it is a Section 3 violation for dropshipping anyone responding needs to see the language to determine if it included the 'death sentence' wording.

Can you answer these questions first --
DO YOU have an LOA from the brand allowing you to sell on here?
If you have an LOA that specifically says you can sell on Amazon you MIGHT survive listing items.
More and more brands are providing a "whitelist" of their approved sellers and if YOU are NOT on the list you will be stopped in your tracks and probably hit with an IP violation.
DID YOU source from AUTHORIZED wholesale sources that your rep at the brand says are OK? You DO have a sales rep at the brand, don't you?

Hello,
I received the following suspension notice from Amazon. I have removed any personal information.
[Suspension Notice]
Hello Seller,
Your Amazon Seller account has been deactivated and your listings have been removed in accordance with Section 3 of the Amazon Business Solutions Agreement. Funds will not be transferred to you but will be held in your account while we work with you to address the following concerns.
Why is this happening? You have items listed against an ASIN that is mis-branded, and is infringing on a third party’s rights. This is a violation of our policies. In order to ensure that customers can shop with confidence on Amazon, we may require sellers to obtain additional approval to list certain products and brands.
-----------------------------------------------------------------------------------------------------------
Could you check if this notice includes the “death sentence” wording?
Current Situation:
• 4 ASINs are affected.
• 1 ASIN: I received approval from the brand headquarters to sell on Amazon Canada and purchased the products directly from them, but they do not provide an LOA
• 1 ASIN: Purchased from a Korean wholesaler, but the brand has confirmed that they do not provide LOAs to any Korean sellers.
• 2 ASINs: Purchased from Korean retail stores.
Ultimately, no supplier is providing an LOA.
However, when I called Amazon Seller Support, they told me that an LOA is not required and that I only need to submit invoices.
But after multiple appeal attempts, it seems like an LOA might actually be required.
How can I resolve this issue? What would be the best approach in this situation?
I appreciate your advice. Thank you.

"• 1 ASIN: I received approval from the brand headquarters to sell on Amazon Canada and purchased the products directly from them, but they do not provide an LOA"
Do you have anything in writing from them that says they gave you approval? This is the ONLY one that you have a chance if they said it in an email even though it might not be strictly an LOA.
"1 ASIN: Purchased from a Korean wholesaler, but the brand has confirmed that they do not provide LOAs to any Korean sellers.
You don't say if this is an AUTHORIZED wholesaler. No LOA from the brand but did you ask the brand if the source is AUTHORIZED? One major Asian wholesaler has caused many sellers to get suspended because they are nothing more than a gray market source. Do a search for "Asian Beauty".
• 2 ASINs: Purchased from Korean retail stores.
If the other two were not enough to kill your account this one is. You are trying to sell using a sales style that has been restricted (especially for almost all brand products) for a few years now. You would have known this if you had studied the Forum for any time at all looking for reasons for suspensions.
Ultimately, no supplier is providing an LOA."
THAT is the bottom line cause for your suspension and was easily preventable. Go sell elsewhere but at least put in a little effort to learn the rules for the next site BEFORE you start selling there. You are DONE on Amazon.
For any other rookies out there reading this --
THE AMAZON TWO STEP -- A NEW DANCE FOR SELLERS
More and more frequently Amazon is taking a TWO STEP approach and you are probably caught with not doing one of the steps (or either one!)
You are confusing AMAZON allowing you to list (or at least "ungate") an item or category and actually being APPROVED to sell a product. Amazon might ungate you for a CATEGORY, but there can be 100's of brands in the category and they ALL have their own restrictions.
AMAZON is only interested in FEES. They will allow a chimpanzee to list if it means they collect $$$$$.
Additionally, brands that you COULD sell yesterday may be restricted today or next week. Amazon is a moving target to deal with.

NOTE the verification is required from the brand that the source is legitimate and authorized, NOT from one of those touted on TikTok and YouTube as having "thousands of brands and products" that assures you that they are authorized.
If you have watched any YouTube or TikTok videos FORGET everything you saw there.
Spend hours/days on Seller U and read the Forum to see all the really creative ways rookies and experienced sellers find to get suspended by ignoring the advice above!

If you don't already have the above requirements in place you are probably going to have stranded inventory (if you do FBA) and a suspended account.

"It’s a well-known Korean skincare brand. "
There is an excellent reason why @Seller_nRFmxiQg4EGrwhas said to say what the brand is.
By naming the brand you MIGHT save some other rookie seller from getting suspended for trying to sell the same brand.
EVERY seller on here that gets suspended is a case study to others on how to AVOID the same fate.
You are done, but you can help save other newbies by giving actual answers and facts.

People don't usually come back from a section 3 violation anymore. Your only path is to proof that Amazon made a mistake and you are innocent. Your suspension notice should give you details on this

If you want actual help, you need to stop being coy, and actual be honest about what you are selling.
When answering a question like "What brand are you selling", saying "a well known brand from a foreign country" doesn't help in the least. Name the ACTUAL brand you are trying to sell.
Granted, that may still not help; but it at least stands a chance over "just guess".
