ASIN created using seller's store name as Brand

Hello everyone.

Given the strict policy on Amazon in regards to product brand name, how does one able to create a listing of a non-manufacturer multi pack combo using the sellers own store name as the Brand?

For example: X Birthday Cake Protein Bars, Very Tasty, High In Protein, (In ABC Packaging With Sticker)(2 pack 4 bars)

In this example, I'm using "X" as the product brand and "ABC" as the store name. Please note that the store is not the actual manufacturer store.

I have only been on this platform for six months now, and been seeing many ASINS for multi pack variation created/listed this way. Isn't this illegal and violates the IP policy since you are replacing the actual product name? And if so, how are they able to create such listing anyway since that shouldn't get pass certain steps in the Adding New Product tool?

As we all here to make money, I'm still learning how to create and manage high return and profitable listings, but I also prioritize not doing so while risking to get deactivated and kicked out of Amazon.

Any insights?

This is explainable because there are brands who don't care who sells their products. I imagine that Amazon reacts only if the concerned brand is placing an IP complaint.

But in fact in my eyes it IS violating the policy like some other listings that have under the title "Brand A" and on the picture "Brand B".

It is a policy violation to offer multi-packs from a brand unless they are packaged that way BY THE BRAND and have a GS1 UPC from that brand.

Besides that, your listings is clearly a violation.

They cannot do it. They will be caught.

Amazon first deals with listings that received an actual claim.

Other violators takes longer to found. The bots are constantly crawling all over the place until they sniff them out.

This actually is considered a custom product bundle- it's not in violation of amazon policy.

you can get approval to list your brand, even if not trademarked, file case.

might have to show upc, which you can buy, we listed boca hydro for 15y before we got trademark

If the seller has their company name brand registered, this is an easy thing to do. This is typical with customized products. Now how they are able to use the actual manufacturers name or brand in their product name or description is another thing. The manufacturer is obviously not monitoring this and not reporting it to Amazon.

You must consider the use of someone else’s trademark carefully. Usually, the unauthorized use of a trademark in the creation of a detail page is infringing if it is likely to cause confusion as to the source, endorsement, or affiliation of the goods. However, just because you are not the owner of a trademark does not necessarily mean that you cannot sell another company’s product. Nonetheless, it is important that you clearly distinguish between yourself - the seller, and the trademark owner - the source of the product.

This actually is considered a custom product bundle- it's not in violation of amazon policy.
