Any way to permanently opt out of PAN-EU eligibility?

We have a major issue with the way Amazon PAN-EU eligibility works.
The short story is that Amazon makes our products Eligbile and starts moving inventory around EU and then makes our products ineligible and we are left with inventory in marketplaces with no demand resulting in expensive EFN fees on our cross-border fulfilled sales.
The details of the story is that we sell food supplements in most EU countries including UK. Since our products are categorized as FOOD, they cannot be eligible for PAN-EU ever according to Amazon policy. This means that we have to replenish inventory to each marketplace individually (DE,FR,IT,UK etc.) and maintain the right inventory in each marketplace which is a difficult task.
The issue is that Amazon sometimes make our products Eligible for PAN-EU benefits. From the records I can see that it is no more than 1 minute or so, so it is obviously a glitch/error internally. However, this 1-minute PAN-EU status allows Amazon to initiate Warehouse Transfers of our inventory because it thinks that it needs to distribute our inventory according to the PAN-EU benefits. Now this would be amazing if we kept PAN-EU eligibility but we dont and we cant because of the FOOD category. So the result is that our inventory is moved around to MPs where we have practically no demand. So for example, Amazon moves 600 units from Germany to Spain where we have 1/100th the demand we have in Germany so when we run out of inventory in Germany, orders are fulfilled using EFN from our Spain invenory which is expensive and ineffecient.
I hope an Amazon representative can pitch in here because I have tried to get through their seller "support" without any luck.

Pan-EU is an opt in programme, so you should be able to opt out easily.

Thank you for your reply but it is not directly an "opt-in program" they have criteria that can be met or not and if met your are "enrolled" and they check eligibility every other day or so.
Here is the text from their settings:
"
Here is how: Activate offers for your qualifying products in ALL required marketplaces to qualify for benefits (typically UK, Germany, France, Italy and Spain). Allow Amazon to distribute and store your products in additional countries. Benefits apply to marketplaces where storage is allowed. Where you have a VAT number, we will automatically enable inventory storage.

Yes there are requirements, such as being VAT registered in each country you want to store in. That doesn't stop it being an opt-in programme. You can just disable storage in the relevant countries.
If you have other products that you want to keep in Pan-Eu then you can disable specific ASINs:
"To exclude an ASIN that meets the auto-enrolment criteria from Pan-European FBA, go to the Manage inventory page in Seller Central and deactivate the offer in the marketplace or marketplaces where you don’t want to sell the product."

To exclude a product from the Pan-Europe FBA program that qualifies for automatic enrollment, simply refrain from listing it in the required countries.
Deactivating the offer in the store or stores where you do not wish to sell the product is the necessary step.

Did you resolved the issue with PAN-EU?
I think you have same barcode/FNSKU for all marketplaces. You can create different SKU/FNKU for each marketplace and then there is no way for inventory to be distributed across EU.
