Dr Pen Ultima M8

After seeing thousands of listings on Amazon for the Dr Pen brand of microneedling devices, I decided to list my own. I applied for a GTIN exemption through Amazon and received approval to list my Dr Pen products. What happened next can only be described as illegal discrimination, and I know I’m not the only seller to suffer this at the hands of Amazon.

Immediately after posting my listing I get a notice from Amazon that it was under review and removed from search results for potentially being a prohibited item. The email states:

"We are writing to let you know that the following detail pages have been removed from our catalog:

ASIN: B0BPDJJ56Q, SKU: ZJ-3Y2H-OYV8, Title: Dr. Pen Ultima M8 Wireless Microneedling Mesotherapy Dermapen Kit + (2) 16-PIN, (2) 36-PIN, (2) NANO Needles

This product has been identified as a microneedling skin roller or similar product that is considered a medical device due to either (1) the product’s technical characteristics, as the product’s needle length is greater than 0.3 mm, (2) the inclusion of medical marketing claims in the product details and/or images, or (3) a combination of both technical characteristics and marketing claims."

It does strike me rather odd that I supplied 4 different links to 4 different listings for the same product that Amazon removed from my catalog, as well as screen shots of those listings and screen shots of Amazon’s own search results for the exact same product they told me is Prohibited, and yet all of those listings are still online and selling. Amazon is 100% aware of those listings and now I’ve created a legal precedent in my case log with Amazon, that despite being aware of thousands of other listings and hundreds of other sellers selling this same “Prohibited” item, Amazon is NOT taking action against those sellers, NOT removing their products from the Amazon website, and is only singling out my account and my listing. If in fact the item is prohibited, NO ONE should be here selling it and Amazon never should have approved my brand exemption, considering DR PEN is a MESOTHERAPY MICRONEEDLING DEVICE.

So this post is to begin collecting other sellers who Amazon has unfairly discriminated against. Gather your evidence and post it here. Soon we will have enough for a class-action lawsuit for discriminatory trade practices against Amazon. Amazon can choose which products to add or exclude from it’s catalog, but what it cannot do is illegally enforce their “policies” in a discriminatory fashion against some sellers, while ignorantly allowing other sellers to continue selling the same product. These types of practices need to end and it’s time to hold Amazon accountable for their actions.

I doubt that Amazon is discriminating against you, some of these other sellers have managed to slip past the BOTS, or may have found some blackhat or back-end tactic as a workaround.

You are giving the SS reps waaaaaaayyyyyyyyyyy too much credit on what they actually can do. What you are expecting is what only people extremely farther up the chain can do.

Again, it comes down to understanding how the system works AND that anything is not instantaneous.

You are correct that if you can’t then these other ones can’t, that shouldn’t be called into question. The thing is is that this is how it works here. Once they do decide to take action, then it will be all at once and rather swift.

Unless I am missing something this is just a temporary removal to check your items. There is NOTHING TO DO OR WORRY ABOUT AT THIS MINUTE. Amazon will do their check and if you are correct the item will come back to the site, no problem. If you are not correct well, that will be an entirely different ending. I do not know your arena so I can not comment on that.

They do this investigating stuff to us from time to time. Thankfully they almost always leave the item up during their “inspection” but our account is old and big which may or may not help. This happens for any number of reasons but in our case it is often a customer or competitor complaint or a bot gone wrong. They just happen to be mistaken, yes again and again over time. Amazon takes some claims very seriously even if just ONE and will take a look at your inventory. This protects them and should not bother you one bit if you are following the rules. If you are BRAND new you will get a harder look and my guess is they remove to be safe on a temp basis. In our case the items get off of the temp investigation quickly as in hours to a few days. In our early days we would be scared too and tell them to open as many as they need to verify and on and on. There is no need for any of this as that is what they will in fact do!

Good luck and if you what you claim is correct you have zero to worry about, just be patient.

This just shows the decline in quality (AND SAFETY) of the AMAZON site! NONE of these products should be sold on AMAZON! Unless one is very careful in prep you can give someone some nasty skin infections!

Unless I am missing something this is just a temporary removal to check your items. There is NOTHING TO DO OR WORRY ABOUT AT THIS MINUTE. Amazon will do their check and if you are correct the item will come back to the site, no problem. If you are not correct well, that will be an entirely different ending. I do not know your arena so I can not comment on that.

They do this investigating stuff to us from time to time. Thankfully they almost always leave the item up during their “inspection” but our account is old and big which may or may not help. This happens for any number of reasons but in our case it is often a customer or competitor complaint or a bot gone wrong. They just happen to be mistaken, yes again and again over time. Amazon takes some claims very seriously even if just ONE and will take a look at your inventory. This protects them and should not bother you one bit if you are following the rules. If you are BRAND new you will get a harder look and my guess is they remove to be safe on a temp basis. In our case the items get off of the temp investigation quickly as in hours to a few days.
