Suppressed buybox due to a reseller undercutting price outside Amazon

A reseller listed our product outside Amazon at a very low price. It is almost half of the MSRP. Amazon detected it and considered it as the competitive price. Hence, our amazon listing got suppressed at its supposed MSRP price.

We opened multiple case with Amazon support stating that we are the brand owner and we set the MSRP. In addition, we already reached out to this retailer and they said that they don't want to cooperate at all. We planned to send a cease and desist letter to the reseller however, we don't have a contract to enforce it either.

Any advice?

You may be able to contest and provide manufacturer's proof of the MSRP, however in general Amazon does not enforce MSRP pricing. This is generally an agreement between the distributors and retailers. If you provide your most recent Case I can see what options exist to escalate this issue further. As mentioned, Amazon does not enforce MSRP. In this instance the issue is another Seller on Amazon listing the product. If you think the Seller is listing a product that doesn't match the detail page you can do a test buy and report the Seller through the Report a Violation tool in your Brand Registry account.. If you have issues with other sellers that are selling your items at a cost below the MSRP, causing pricing issues, it's your responsibility to work with those you are selling to and if necessary, stop selling to those that are selling at a lower price elsewhere. You can review how to Report A Violation if you need further guidance on how to make these reports.

I can take your feedback on these concerns, however if the issue is that the other Seller doesn't have appropriate inventory the correct path is to report the Seller on Amazon.

If you are the manufacturer, don't sell to the guy anymore. Once his stock is depleted, then he's done and you can recover from this. If he is buying thru a distributor, your only option is to stop selling thru a distributor to take control of your product and pricing.

This has been going on for a while now. It is a disgusting loophole for competitors to knock out other sellers buy box privilege by simply listing for less. In your case it is even worst since you are the brand owner and the other seller is selling a fake item. Amazon continues to allow this nonsense and that is why they are rapidly losing shareholder value and are on the verge of collapse for the Amazon marketplace business. We sell for major brands and we have given up on Amazon, almost all our competitors who have gained control of Buy Box are selling fakes or different country versions of products for less causing genuine sellers to leave. The evidence is clear in their seller reviews where customers openly call out the fakes and different versions, yet Amazon somehow allows them to keep the Buy Box.

The only reason they have been able to stay afloat is due to the cloud computing AWS business, otherwise this whole website has become a shell of once great American marketplace.

They removed OUR Buybox over 2 years ago and we are the ONLY product in our class. Our item is a LIFETIME use and warranty item- NONE of the other cheap garbage from overseas can even compare, yet they continue to compare us to the lower priced junk unfairly. Scamazon can make all the excuses they want, but WE all know the truth. Karma is coming for them...soon.

The bigger issue is Amazon's stupidity, which every single seller pointed out when they rolled out this insane, counterproductive policy years ago. Why would they HIDE (really, they're effectively removing in the eyes of many customers) the option to buy something from them? Don't they want the commission from the sales? Why would they drive sales AWAY from Amazon?

Of all the horrible policy decisions I've encountered in over 20 years selling on Amazon, this remains by far the stupidest and most destructive—it's bad for sellers AND it's bad for Amazon. Good grief.
