Do the Following Terms Infringe Trademark No. 477514 "INBUS"?
We have received a trademark infringement complaint from the rights owner of Trademark No. 477514 ("INBUS"), which has resulted in the removal and suspension of our listing.
However, we did not use the word "INBUS" as a brand or trademark or gerneric word on our listing. Instead, we only used the following descriptive terms, which are commonly used in German or Dutch to refer to hex keys or Allen keys:
Inbusschrauben
Inbusschlüsseln
Schlüsselsatzes
Inbusschlüssel
inbussleutel
inbussleutelset
Innensechskant
We kindly request clarification:
Do any of the above terms constitute a violation of Trademark No. 477514 ("INBUS") under Amazon’s Intellectual Property Policy?
These terms are widely recognized as generic or descriptive terms in European markets and are not used in a trademark sense on our listing.
Thank you for your attention and guidance.
Best regards,
Doris

Solange die Marke Inbus eingetragen ist gilt sie als geschützt, auch wenn der Begriff "Inbus" umgangssprachlich eine Gattungsbezeichnung geworden ist.

Hello,
The term "InBuS" is an acronym for "Innensechskant Bauer und Schaurte"
Inbus is a Trademark of a the Ruia-Group who bought Bauer und Schaurte and the brand Inbus. And they are still selling tools. So Amazon is totaly right how they do
That is not possible. I would be the same like you want to sell a car using the Name Mercedes-Benz, but it is not.
You cannot use "inbus" to describe. In German, "imbus" is a colloquial term for an Allen key. But even with IMBUS, I'm not sure whether that doesn't also violate the trademark. You chould ask a lawer for that, or use the regular term "Innensechskant"
Yes, all! Beside: "Schlüsselsatzes" and "Innensechskant"
I do not think so. But I can only speak for germany. In germany it is not generic in the markets. But "Imbus" has become a colloquial term.
If it is a trademark for a same or similar product you are not allowed to use it in any way.
It is the same like "Plexiglas" and "Acrylglas" or "Bakelit" and "Duroplast" or "Tempo" and "Papiertaschentuch"
