Previous VAT transaction reports- correction needed

It has been over a year since I received an email for Amazon saying thet I am non-EU established for VAT purposes and that I owe Amazon over 50000 for historical VAT. My disbursements were blocked.

At first I was confused because I am an e-resident of Estonia and my company is there. The whole point of e-residency is for the company to be EU-established even when personally living outside of EU. My Estonian accountant was confused, the Estonian authorities were confused, but in the end I accepted it and I paid Amazon this money, which was demanded from me with no detailed breakdown of what I was paying ( I had to specifically ask for it, and this breakdown report is completely unusable with the tax authorities or tax advisors). Also, after I paid off everything which took me almost 8 months, I was hoping to get some proof that I paid Amazon for this VAT, but no, again all I got was the same csv report.

Before all this happened, I was part of VAT services on Amazon and I paid my VAT regularly directly to the authorities as I was instructed. I was also part of the OSS program.

Now, in order to get my money back from the authorities, I need some proof that Amazon has paid VAT for me besides "we will honor our obligation". They cannot accept that! After counless emails, I realized that this is impossible, my requests and pleas were being completely ignored. All I eve got was: ask your tax advisor to help you with the refund.

I have contacted many tax advisors and I have been in contact with the German tax authorities. I am now working with a tax advisor for many months on this problem. Why so long? Because every time I ask Amazon for something, it takes weeks and month to get an answer.

The main issue I have now is: the VAT transaction reports on seller central from July 2021-May 2024 are wrong and they need to be corrected. The VAT resposibility is wrongly on the seller in those reports, when they should be on the marketplace. But when I ask for these to be corrected, because it is Amazon's mistake and I cannot upload it on the tax advisor's portal (it is automatic download) all I get is the same darn csv report.

I do not know anymore who to contact. Everyone keeps transfering my case to some mysterious "professional teams". I need actual help. PLEASE.

Best regards,

Snezana

In such a serious case and if Amazon's behavior is questionable under tax law, I would file a complaint and hand the whole thing over to a lawyer experienced with Amazon. Post the whole thing in the wortfilter group on Facebook, where such lawyers are present.

Hey

Submit a Formal Written Complaint to Amazon

Prepare a registered postal letter or legal notice summarizing your case clearly. This often gets escalated more effectively than Seller Central support.

Amazon Services Europe S.à r.l.

5, Rue Plaetis

L-2338 Luxembourg

Attn: VAT Compliance Department

Include:

  • Your full Seller ID and account name
  • A detailed timeline of correspondence and events
  • Exact explanation of why the reports are incorrect
  • Demand for either corrected VAT transaction reports or official confirmation that Amazon accounted and paid the VAT in your name

Use legal language if possible — your tax advisor or a local legal counsel can help here.

Contact Estonian Tax Authorities (MTA)

Even if they've been confused, submit a formal inquiry to MTA explaining the situation. Sometimes a letter from them to Amazon may carry weight, or they can at least clarify your compliance history for other EU states.

Escalate to European Commission (SOLVIT)

Since this is a cross-border tax issue affecting your business within the EU, and you are being denied tax clarity and proper treatment, SOLVIT may be able to help. They specialize in internal market problems between businesses and EU governments or large companies.

File a complaint here: ec.europa.eu/solvit

Make sure to describe how:

  • Amazon misapplied VAT responsibilities despite your EU business registration.
  • Amazon is withholding proof of tax settlement.
  • You're being blocked from reclaiming money due to inaccessible/corrupt data.

I hope this will help.

Best Regards, M.

Hello @Seller_TdwQHLE4B7EGx

As reported on this page, it is not possible to make changes to the VAT transaction report as it is auto-generated by the system. Please note that if you have Amazon sales or refunds in your Amazon VAT Transactions report, then you will be unable to make changes to the VAT calculations. This is because VAT invoices have been raised for these Amazon sales and refunds, and it is important for VAT purposes that the VAT declared on your VAT filings matches the VAT declared on your invoices. Use the following link to have a complete overview on how transaction report is working:

https://sellercentral-europe.amazon.com/help/hub/reference/G202098630#GUID-47859AC9-B2C4-4851-A190-7AF9E301F97B__SECTION_C3EEE300074B4FB1BDE92E6216FC8132

However, you are able to make changes to some product information in the Amazon VAT Transactions Report by updating your product tax file and regenerating your VAT filings. Check here for more information:

https://sellercentral-europe.amazon.com/help/hub/reference/202104830

To request further assistance and request proof of tax payment made by Amazon for your account, contact the Seller Partner Support (SPS) team at this link:

Thank you for posting.

I hope my answer has been helpful.
