Remove Chinese Seller From My Listing
I am the brand owner of Nesta Home, which is a registered brand on Amazon. We don't distribute our products; however, a Chinese seller listed our ASIN (B0CJ1M5LKS) under our brand name. Our product has a unique packaging with our logo. They either send different products or counterfeight products.

I have opened several cases with Seller Support but they are completely useless with their copy-post responses as always. I also reported violation but nothing changed so far. Amazon asks an approved trademark number but my trademark application is still pending. Amazon indirectly says that they allow Chinese sellers to sell counterfeight products and violate brand owner's rights is OK for the first 1 year of the brand.

Please help me in this regard. I am very concerned beacuse the fake seller will ship low quality products and it will affect my product rating. Amazon should protect their customers from these scammers.

My name is Dougal from the Community Manager Team and I would be happy to assist. Thank you for the case ID's and as an FYI, I do not have the ability to review complaint ID's unless they are submitted through the Report a violation dashboard from Brand Registry. The responses you have received from Seller Support are correct, but let me provide a bit more context and explanation so that you can take action.
There are 2 different routes you can take and that direction will depend on what you find from completing a test buy from the seller's offer that you suspect is different or counterfeit.
- If the product received is counterfeit or not the same as described on the product detail page, submit a listing violation via "Report Abuse," in the top left of your Account Health Dashboard on Seller Central. Choose "The product received is different than the product on the detail page (different version, model or product)," and provide the order ID and relevant detail.
- If the product received is violating your Trademark in a way that is not counterfeit, you can submit a complaint via Brand Registry report a violation dashboard. Once you search the ASIN, click on "Show offers," this will allow you to select the specific offer and then the infringement type in the top right. The next page will have you fill out all the relevant detail (including order id). If your complaint is accepted, the offer will be removed
Further explanation for #1 above. Because your TM is still pending you cannot report counterfeit so, I advise to take this route because (depending on the specifics) this can be a violation of Selling policies and seller code of conduct.
Further explanation for #2. A very common pitfall when Sellers are reporting infringement is that they describe how the product is counterfeit and not how the product violates their TM (reporting counterfeit has its own work through). I STRONGLY recommend taking the time to review the Intellectual Property for Rights Owners help page. Specifically the sections "Types of notices not accepted on Amazon," and "Reporting Infringement." The latter is super important and will provide you detail on what you should and should not include in your complaint as well as some best practices.
