false counterfeit claims

I received a counterfeit claim by the brand on one of their products I was selling on my storefront. It has negatively impacted my account health. I understand the brand's concern and would have gladly removed the products if they had contacted me but the products are original and not counterfeit so why is Amazon negatively impacted my account for an original product that the brand just didn't want to be resold on amazon? I try my best to keep up with compliance but this is extremely unfair. How else are resellers going to survive if the brands just label original products are fakes and get away with it? They should instead file a claim to have the products removed and sellers should comply and remove them from their store fronts but what is the need for killing someone's storefront? I am afraid to keep investing in my Amazon store further, if there is no long term solution for this, I'll have to close my seller account and have peace of mind instead.

It is not up to the brand owner to chase after everyone who would like to sell their product. It is up to the seller to do their due diligence before listing any product.

Even if the brand owner did contact everyone who did this, can you not imagine the headaches of sellers who would want to back and forth "explaining" why they improperly listed an item? Of course they are going to do it the easiest way for themselves.

Sorry to hear this may "destroy" your store. Amazon is not easy, best of luck for your peace of mind.

All you have to do is prove it to Amazon by showing authorized invoices.

Hello @Peace_blessings,

Thank you for your post regarding a complaint from a brand.

This particular concern would appear to be a received intellectual property complaint.  These complaints, as you’ve mentioned come from the brand or rights owner. This occurs when they cannot verify you as having an authorized supplier.

Most of these situations will require you to verify this with a letter of authorization, licensing agreement directly from the brand or rights owner. You may also provide invoices that show you’re sourcing your products from an authorized distributor, manufacturer or the brand itself.

I try my best to keep up with compliance but this is extremely unfair. How else are resellers going to survive if the brands just label original products are fakes and get away with it?

As you mentioned trying you best to keep up with compliance, I would recommend checking out our intellectual property policy for sellers. This will provide a generalized guidance on your requirements when it comes to intellectual properties.

I would also like to inquire what your listing process was regarding this brand and product. Did you received authorization from the brand to use their intellectual properties or sell their products using their brand? Are you sourcing your products from an authorized distribution channel? Can you provide any of the required documentation to show proof of compliance to these policies?

I would also recommend reviewing our responsible sourcing documentation request requirements to help verifying your documentation meets our requirements.

The forums community and I are here to support you. Please let us know how we can help you from this point forward.

Hello @Peace_blessings,

Thank you for following up on the situation.

Thank you for your professional response. I understand that having an authorized letter from a distributor is acceptable. However, what about authorized retailers like Ultra, TJ Max, Walmart? These retailers have discounted deals on original products and to my knowledge Amazon allows it's sellers to purchase these items and resell them on Amazon marketplace.

We do not provide authorization to source branded products from specific retailers, we do advise on obtaining invoices, or letter of authorization from an authorized distributor or manufacturer, otherwise we recommend obtaining a license agreement with the brand itself.

There are authorized retail invoices available for these purchases but they are retail invoices and not distributor invoices. What to do in these situations? Will Amazon accept the retail invoices and let the sellers sell the products?
I would also recommend reviewing our responsible sourcing documentation request requirements to help verifying your documentation meets our requirements.

Depending on if that retailer is an authorized distributor for the brand, I cannot confirm if they would be valid. Receipts have been accepted from authorized distributors, but you may need confirm their authorization with the brand.

Additionally, if you have not, you can review the help page on these document request to ensure your documentation meets our requirements. Have you attempted to appeal with your purchase receipts? Does the brand of the product show on the purchase receipt?

The forums community and I are here to support you. Please let us know how we can help you from this point forward.
