STUCK IN A LOOP - Can't get brand approval
I am stuck in a loop. My first application to register a custom brand I created was denied because Amazon said my packaging was not exactly matching my brand name.
I applied for a unique name like (for example) "ABC123 Premium", but my packaging showed “ABC123 Premium Watches" and a slogan along side it on the box. Like “ABC123 Premium watches – It’s time for a great watch" (again, just an example).
Amazon denied the brand name saying it did not match exactly. I took it that I needed to add “Watches” to my brand name since the box showed that. So I submitted a 2nd application. This time, I made it match. Brand name = ABC123 Premium Watches. Boxes show that and the slogan on it.
Once again, it was denied. Now Amazon is saying the brand name is already approved and they denied my request!?!. My brand name is very unique and I did a search of Amazon and it reveals no hits or nothing close to it. Is Amazon getting confused with my previous application they denied? Are they using AI robots to make decisions? I am stuck and cannot get past this.
I wish I could speak to a real live person that can clearly tell my what my exact issue is, assign from a canned/template response.

If you have opened any cases provide a number so any MOD that happens to drop by can look it over to see if they can help.
Without a case number in the posts it wastes time for everyone. I no longer tag anyone if there is no case #.
They have to ask for it and then wait for a reply from the poster and then the poster has to wait again for the MOD to find the case, and then more waiting.…………....

Here are some of the most common issues with BR.
Go over everything with a magnifying glass looking for a missing 'period' or 'comma'.
Is there a different capitalization, abbreviation, spelling, or, even an extra spa ce?
NOTE -- you already found one such error. Are there more?
Is your Brand registered (or applied for) with the USPTO?
Amazon is admitting applicants under CERTAIN conditions when only filed but not granted.

“To be eligible for Amazon Brand Registry, your brand must have an active registered trademark in each country where you wish to enroll or have a pending trademark application filed through Amazon IP Accelerator. Brand Registry is also accepting brands that have a trademark pending registration in a subset of trademark offices.”
Additionally, IF you ever get an actual TM (if you don’t now) When Amazon says something must match they mean EXACTLY!
That means Street is not ST.

They mean every comma, period, dash, etc. must be EXACTLY THE SAME INCLUDING SPACE S.

What is the EXACT BRAND (as GRANTED) on the USPTO site? Is it the EXACT same as the Brand on the Amazon account AND the brand on the packaging?
What is the name of the Owner (REGISTRANT) on the USPTO site? Is it the EXACT same name as the owner of the Amazon account?
If it is NOT exactly the same you will need to show some proof that the two are the same. As I recall, I had to submit my LLC State Registration with MY name as the owner of the LLC since my Amazon account is under a different LLC name.
The OWNER of the Brand is the one that MUST enter into the Brand Registry agreement. If the owner is not the same as the Amazon seller the seller will have to be granted access by the owner AFTER REGISTRATION.

I see no extra spaces, capitalization, etc. Yes, I made a mistake with the first one, not realizing I needed to be absolutely exact. But my second one is seemingly exact in every way, but now I have a new reason for denial, saying someone else already has that brand. I cannot see anyone else with this unique brand name, other than me trying to get it done.
I do have a slogan on the box as well. Does anyone think this is the hold-up? I have brand name on the top line. Slogan on line 2. Ugh.
I have not registered the brand name yet through USPTO as my concern was.... Pay that money and get it pending, THEN Amazon denies it. It's almost like "chicken and egg". So I went through the process of trying to get an exception, showing pictures of my product, packaging, GTIN, etc. I cannot see any differences in spelling, wording, capitalization, etc. with the brand. Puzzling that on my 2nd attempt, I have a new reason for denial. Again, wondering if Amazon somehow sees my first attempt and almost sees this as that the brand is already taken. I am hoping someone sees this and can help. I have the product on hand, packaging, and hoping it was not all a waste of money. Hoping to get this approved, finish the steps of sending it to Amazon, getting the shipping plan going, then when I see sales, then apply through the attorney and USPTO.
