Reporting a copyright violations

Hello,

Few weeks ago I asked if it is possible to report a copyright violation without having a registered trademark or registered design. Someone from Amazon support told "yes" and gave me a link with FAQ.. Didn't help at all. I reported these violations and immediately got rejected (I mean nobody even read my complain, as I got rejection email almost same time I pressed "Submit report". I was asked to provide additional information, but same, I got this email:

"Good day,We have reviewed the infringement reports and additional information you reported and were unable to verify the information you provided. If you believe this is an error, please resubmit your report. When resubmitting, please enter the verification code aaa-aaaaaaaaaa and the additional information requested."

So I would like to ask for help again, this time I will try to give as much details as possible. So the story is that in 2017 I started a print-on-demand business. I was selling various graphics designs that I made printed on various products (clothing, home appliance etc.). Later I sold the business to another company (stock, equipment, database, all the graphic designs) and closed my seller account. However, I never registered a trademark or registered designs anywhere. Few months ago, people from that company contacted me and told that there is another seller, who ripped off my graphic designs (I used high resolution images to create listings to make better experience for customers) and started selling cheaper. As a result that company lost buy boxes, so I tried to report the seller. I made several test buys, as when you try to report via this link:

https://www.amazon.de/report/infringement

Amazon asks if I made test buys. I know that these products are counterfeit, but still I made test buys, just so I can fill all the information Amazon asks me. Entered order IDs, filled all the info, explained everything and as I told before, I got rejected. So my question is: how to report this seller so I won't be rejected? Is Amazon looking for a person/company who created the ASIN?

img

Here I selected "Copyright infringement". Maybe I needed to use "Design right infringement"? What is the difference between these two?

I am 100% sure, that I can report the seller, just do not know how. I have a screenshot, when someone reported my listings as "not authentic", even I personally created these graphic designs. One day I saw this notification:

img

I do not know if it was an angry customer or my competitor, but listing was removed. Another question: If I can't report the seller as a copyright owner, how can I report it as a customer? Because this report is called "Product Authenticity Customer Complaints". It means that someone bought it from me and somehow reported it. I tried to do that too, as I bought these inauthentic products from the seller, I have orders IDs etc. but I only could open an A-Z claim for not received order or not as described, but there is no option to report inauthentic product. So how somebody was able to report my listing as a buyer? Can anyone give me instructions step by step, how to do it?

Hello @Seller_DOMBMbIGG6z2i,

My name is Dougal from the Community Manager Team and I would be happy to assist and provide you some resources on reporting Intellectual Property violations.

First, please review the Report intellectual property infringements help page. The Seller University video on that page will provide step by step instructions.

You may also find this post from @Sandy_Amazon helpful, How to properly report a Violation.

I do see that you have your brand registered in Brand Registry, are you reporting via the Brand registry site or report infringement through the report abuse link in the Account Health Dashboard from Seller Central?

If the brand in question is the brand you are the rights owner, my recommendation is to report via report a violation. Which infringement type you select depends on what you discovered form your test buy. The linked help page as well as the linked post provide definitions of each to help you in that decision.

The next advice I have to offer is whichever infringement type you select, only provide details related to that infringement type. For example, if you are reporting Trademark Infringement on the product or its packaging, do not provide detail about how it is counterfeit since that is a different type of infringement to report.

Hope this provides enough for you to take your next steps for reporting the infringement. Please let me know if you have any other questions.

Best, Dougal

Amazon doesn't even care. A Chinese company ripped off my original copyrighted design and I opened a case, and their answer was basically "we see no problem with this" have a nice day. This violation completely destroyed a whole arm of my business and a best seller that was consistently in the buy box.
